If I am an organ and tissue donor, can I also choose to give my consent to post-mortem body donation ?
07 May 2025
Yes. The decision to donate your body is perfectly compatible with the donation of your organs and tissues. Since the aim of organ donation is to save-or significantly improve– the lives of one or more people, the procurement and transplant of organs takes precedence.
At the time of your death, therefore, the possible existence of the consent to organ donation for therapeutic transplantation will be ascertained (by consulting the Transplant Information System), or if there is none, the non-opposition of your next of kin. Should circumstances make organ procurement an unsuitable option, the medical personnel will halt the procedure and initiate that for body donation.
Those who donate their organs and tissues for transplantation and have also chosen to donate their body to science, are made aware that in the case of multi-organ retrieval, the body becomes unsuitable for the purposes provided for by Law 10/2020 (except for cornea retrieval).
